The following legal terms and conditions will govern the contracting of products and services through this website, owned by ACEITES ESCARIO S.L., hereinafter the PROVIDER.

The acceptance of this contractual document implies that the USER:

IDENTITY OF THE CONTRACTING PARTIES

SUBJECT MATTER OF THE CONTRACT

The purpose of this contract is to regulate the contractual relationship of sale born between the PROVIDER and the USER at the time when the latter accepts during the online contracting process the corresponding box.

The contractual relationship of sale entails the delivery, in exchange for a certain price and publicly exposed through the website, of a specific product or service.

PROCUREMENT PROCEDURE

The USER, in order to access the services offered by the PROVIDER, may or may not register on the website by creating a user account. To do this, the USER must freely and voluntarily provide the personal data that will be required, which will be treated in accordance with the provisions of the current regulations on the protection of personal data, Regulation (EU) 2016/679 of April 27, 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and the free circulation of these data and Organic Law (ES) 15/1999 of December 13 (LOPD) on the protection of personal data and detailed in the Legal Notice and Privacy Policy of this website.

In case of creating an account, the USER will select a username and password, committing to make diligent use of them and not to make them available to third parties, as well as to communicate to the PROVIDER the loss or theft of them or the possible access by an unauthorized third party, so that it proceeds to the immediate blocking.

1. GENERAL CONTRACTING CLAUSES

Unless specifically stipulated in writing, the placing of an order to the PROVIDER will imply the acceptance by the USER of these legal conditions. No stipulation made by the USER may differ from those of the PROVIDER if it has not been expressly accepted in advance and in writing by the PROVIDER.

2. SHIPPING ORDERS

The PROVIDER will not send any proof of order until it has confirmed that the payment has been made.

Once the payment has been verified, the product will be physically sent and delivered through a transport agency within the deadlines indicated in the purchase form and in the order voucher, according to its destination.

In the event that the product cannot be delivered to the physical address indicated by the USER, either due to absence, impossibility of access or error in the data provided, the product may be delivered to an alternative point defined by the transport agency or the PROVIDER, communicating it conveniently to the USER.

3. RIGHT OF WITHDRAWAL (RETURNS)

The USER can exercise his right of withdrawal within 14 calendar days, counted from the date of receipt of the product. During this period, the USER may cancel the order, request the return of the product and the refund of the amount paid, without having to indicate the reason or incur any additional cost.

To do this, the USER must contact the PROVIDER directly through the data provided in the order. Once the product has been received and verified, the PROVIDER will proceed to the refund of the purchase amount without undue delay, provided that the product received is the original and is in perfect condition. This refund will be made by means of the same form of payment in which the order was made, unless the USER has expressly provided otherwise and provided that he does not incur any expense as a result of the refund.

ONLINE DISPUTE RESOLUTION

In accordance with Article 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online disputes between the USER and the PROVIDER, without the need to resort to the courts of law, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between both. This body is neutral and will dialogue with both parties to reach an agreement, finally being able to suggest and/or impose a solution to the conflict.

5. FORCE MAJEURE

The parties shall not be liable for any fault due to a greater cause. The performance of the obligation will be delayed until the cessation of the case of force majeure.

6. COMPETITION

The USER may not assign, transfer or transmit the rights, responsibilities and obligations contracted in the sale.

If any provision of these conditions is considered null or impossible to comply with, the validity, legality and compliance with the rest will not be affected in any way, nor will they be modified in any way.

The USER declares to have read, know and accept these General Conditions in their entirety.

7. GENERAL FEATURES OF THE OFFER

All sales and deliveries made by the PROVIDER will be understood to be subject to these General Conditions.

No modification, alteration or agreement contrary to the Commercial Proposal of ACEITES ESCARIO S.L. or here stipulated will have effect, unless expressly agreed in writing signed by the PROVIDER, in this case, these particular agreements will prevail.

Given the continuous technical advances and improvements of the services, the PROVIDER reserves the right to modify its specifications regarding the information provided in its advertising, until it does not affect the value of the services offered. These amendments shall also be valid if, for any reason, the possibility of supplying the products and services offered is affected.

8. PRICE AND TERM OF VALIDITY OF THE OFFER

The prices indicated for each product or service include Value Added Tax (VAT) or other taxes that may be applicable.

The prices applicable to each product or service are those published on the website and will be expressed in the currency EURO (€). The USER assumes that the economic valuation of some of the products or services may vary in real time.

Any payment made to the PROVIDER entails the issuance of an invoice in the name of the USER or the company name that he has informed at the time of placing the order. This invoice will be sent in PDF format to the email address provided by the USER.

9. TRANSPORT COSTS

The PROVIDER allows the following ways to make the payment of an order:

  • Bank transfer to account (sent once the order is formalized).
  • Credit or debit card: secure payment through the Redsys payment gateway.
  • PayPal: secure payment through the PayPal payment gateway.

11. PURCHASE PROCESS

13. APPLICABLE LAW AND JURISDICTION

These conditions shall be governed by or interpreted in accordance with Spanish law in that which is not expressly established. The PROVIDER and the USER agree to submit any dispute that may arise from the provision of the services subject to these Conditions in the courts and tribunals of the user's domicile.
